1. Who are we?
We are Law firm "Avitar", located at address: Ukraine, 01103, Kyiv, 37 Mendeleeva street. Hereinafter, Avitar, will be referred to as "we" and "our".
Private Entrepreneur Myroslav Khmarsky, tax number 3441709411, is the controller of personal data which means that we determine what, for what purpose and how your personal data will be processed.

2. What is the Privacy Notice covered by?
This Privacy Notice applies to our websites and services we provide.

3. How long do we keep your data?
Due to the general rule, we store your personal data during the performance of the contract and three years after. For detailed information please open question 10.

However, you can exercise your right to delete your data. In this case, your data will be deleted from our servers within 30 days of your request.
4. Do we share data with third parties?
Personal data is processed to:

1. Communication between us and you.

We share your personal data with our contractors in order to perform a contract.

If a data transfer is required to complete the transaction, we have the right to do so without your consent.

2. Compliance with the law.

We will disclose your personal data to third parties to the extent that it is necessary:
to comply with a governmental request, court order, or applicable law;
to prevent illegal use of our websites;
to protect against claims of third parties;
to help prevent or investigate fraud.

In order to best facilitate our services to and interactions with you, we may store some of your personal data using cloud technologies managed by our third party service providers.

We have agreements in place with those third party service providers and we require them to operate and conduct themselves in a way that is consistent with our legal and ethical obligations.

5. Do we transfer data outside the European Economic Zone?
The personal data we collect is stored on servers in Ukraine. If you are within the European Economic Zone, you must understand that there will be data transfers to a third country when working with us. When transmitting data, we are guided by SCC (Standard Contractual Clauses).

By default, the data is stored in Ukraine, but we may need to process your personal data in another country. If a transfer is required, we will take the necessary data protection measures and ask for your consent.

However, if a data transfer is required to complete the transaction, we have the right to do so without your consent.

7. What rights do you have?
You, as subjects of personal data, have the following rights:

The right to access information.
You can request an explanation of the processing of your personal data.

The right to portability.
You can request all the data that you provided to us, as well as request to transfer data to another controller.

The right to restrict processing.
You may partially or completely prohibit us from processing your personal data.

The right to file complaints.
If your request was not satisfied, you can file a complaint to the regulatory body.

Right to be forgotten.
You can send us a request to delete your personal data from our systems.

Right to withdrawal of consent.
For data that you have previously consented to, you can always withdraw your consent and we will stop processing it.

8. How do we protect your data?
We are committed to ensure that your personal data is kept secure.
In order to protect the information you give to us from unauthorised access, improper use or disclosure, unauthorised modification, unlawful destruction or accidental loss, we have put in place appropriate technical, physical and managerial procedures.

All our employees and any third parties we engage to process your information are obliged to respect the confidentiality of your personal data.
9. How do we update Privacy Notice?
This Privacy Notice and the relationships falling under its effect are regulated by the Ukrainian Law "About personal data protection". Moreover we are under the scope of GDPR requirements.

Existing laws and requirements for the processing of personal data are subject to change. In this case, we will publish a new version of the Privacy Notice on our website.


If significant material changes are made that affect your privacy and confidentiality, we will notify you by email or display information on the website and ask for your consent.
10. What data do we collect and why?

The data we process is divided into two categories: 1) technical information, collected when you visit our website; 2) data that is provided to us by data subjects.
Categories of our data subjects include: user, client, employee/ contractor of our client, partner and supplier.

If you are a website visitor we collect only technical information about you. Also we can process your name and email address while you contact us.
Client

You become our client on the negotiation stage while we are interviewing you or you fill our questionnaire to start work with us.

When you engage us for services and at points throughout our relationship, we are sometimes required to process your information to comply with our legal, regulatory and risk management obligations. This can include, for example, conflict of interest checks and fraud-related background checks.

Whilst you are a client, we can collect, maintain and process your personal data whilst we supply our services to you.
We can also use your contact information for the purposes of collecting payment from you and to inform you of any changes to the terms of our arrangements.


Depending upon the nature of your instruction to us, personal data submitted by you, on your behalf or which we generate in the course of providing our services to you can also include special categories of information.

While providing our services or performance of the contract we may receive data about our clients’ staff. We need this data for specific purposes and concrete tasks. Be confident that we will inform you personally and explain all the matters on an individual basis.

You become a supplier from the moment you start any negotiations regarding the supply of services / goods / works to us.
Partners

We have partners on these areas of work: social projects, education, legal and strategic partnership.
